Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and GritForge ("we," "our," "us," or the "Company") governing your access to and use of the GritForge mobile application ("App") and all related services, features, content, and functionality (collectively, the "Services").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

1. Eligibility

1.1 Age Requirements

You must be at least 13 years old to use the Services. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Services with the consent of a parent or legal guardian who agrees to be bound by these Terms.

If you are located in the European Economic Area (EEA), you must be at least 16 years old to use the Services.

1.2 Legal Capacity

By agreeing to these Terms, you represent and warrant that:

• You have the legal capacity to enter into this agreement
• You are not barred from using the Services under any applicable laws
• Your use of the Services will not violate any applicable laws or regulations

2. Account Registration and Security

2.1 Account Creation

To access certain features of the Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Choose a secure password and keep it confidential
• Notify us immediately of any unauthorized access to your account

2.2 Account Security

You are solely responsible for:

• All activities that occur under your account
• Maintaining the confidentiality of your login credentials
• Logging out of your account on shared or public devices
• Any damages or losses resulting from unauthorized use of your account

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Description of Services

3.1 Core Features

GritForge is a habit tracking and personal development application that provides:

Goal Management:

• Create and manage personal goals and habits
• Track both "ACHIEVE" (achieving goals) and "QUIT" (breaking habits) goal types
• Set schedules, target dates, and reminders

Progress Tracking:

• Log daily progress entries
• Track on-track and off-track days
• View progress in calendar heatmap format
• Calculate and display streaks

AI Coaching:

• Receive personalized feedback based on your progress
• AI-generated journal prompts for quick logging
• Adaptive coaching tones based on your behavior patterns
• Comeback messages when returning after breaks

3.2 Service Availability

We strive to maintain high availability of the Services, but we do not guarantee uninterrupted access. The Services may be temporarily unavailable due to scheduled maintenance, emergency repairs, technical issues, or force majeure events.

4. AI-Generated Content

4.1 Nature of AI Content

GritForge uses artificial intelligence (specifically OpenAI's GPT-4o-mini) to generate:

• Personalized coaching feedback
• Journal prompt placeholders
• Comeback and motivational messages
• Milestone celebrations

4.2 AI Content Disclaimers

YOU ACKNOWLEDGE AND AGREE THAT:

• Not Professional Advice: AI-generated content is for informational and motivational purposes only. It is NOT medical, psychological, therapeutic, or professional advice of any kind.
• No Guarantees: We do not guarantee the accuracy, reliability, completeness, or usefulness of AI-generated content. AI systems may produce errors, inaccuracies, or inappropriate content.
• Not Human-Generated: AI coaching messages are generated by automated systems, not human coaches or therapists. Do not rely on them as a substitute for professional help.
• Your Responsibility: You are responsible for evaluating AI-generated content and deciding whether to follow any suggestions. We are not liable for any decisions you make based on AI content.

4.3 AI Limitations

AI coaching is designed to support general habit-building and motivation. It is NOT designed to:

• Diagnose or treat any medical or mental health condition
• Provide crisis intervention or suicide prevention support
• Replace therapy, counseling, or medical treatment
• Address substance abuse, eating disorders, or serious behavioral issues

If you are experiencing a mental health crisis, please contact a mental health professional or crisis hotline immediately.

5. User Content and Conduct

5.1 User Content Defined

"User Content" refers to any content you submit, post, or transmit through the Services, including:

• Goal titles and descriptions
• Progress entry descriptions
• Custom notes and tags
• Profile information

5.2 Ownership of User Content

You retain all ownership rights in your User Content. By submitting User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, process, and display your User Content to provide the Services, analyze your User Content to generate AI coaching feedback, and create anonymized, aggregated analytics.

This license terminates when you delete your User Content or account.

6. Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

6.1 Illegal Activities

• Violating any applicable law, regulation, or ordinance
• Facilitating illegal activities
• Infringing on intellectual property rights

6.2 Harmful Content

• Submitting content that is harassing, threatening, abusive, or hateful
• Posting sexually explicit or violent content
• Submitting content that promotes self-harm or suicide
• Creating content that exploits or harms minors

6.3 Misuse of Services

• Creating multiple accounts for fraudulent purposes
• Interfering with or disrupting the Services or servers
• Attempting to gain unauthorized access to any part of the Services
• Circumventing security features or access controls

6.4 Technical Abuse

• Reverse engineering, decompiling, or disassembling the App
• Using automated systems (bots, scrapers) to access the Services
• Introducing malware, viruses, or other harmful code
• Overwhelming our systems with excessive requests

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Services, including the GritForge name, logo, branding, app design, user interface, software code, algorithms, AI coaching systems, and documentation are owned by GritForge or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Access and use the Services for your personal, non-commercial use

This license does not include the right to modify, copy, distribute, create derivative works, or use the Services for commercial purposes without authorization.

8. Termination

8.1 Termination by You

You may terminate your account at any time by:

• Using the "Delete Account" feature in the App settings
• Contacting support@gritforge.io

8.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms
• You engage in prohibited activities
• We are required to do so by law
• We discontinue the Services

8.3 Effect of Termination

Upon termination, your license to use the Services is revoked, you must stop using the App and delete all copies, and we may delete your account data subject to retention requirements. Provisions that should survive termination will remain in effect.

9. Disclaimers

9.1 "AS IS" and "AS AVAILABLE"

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, and reliability.

9.2 No Professional Advice

THE SERVICES DO NOT PROVIDE MEDICAL, PSYCHOLOGICAL, THERAPEUTIC, OR PROFESSIONAL ADVICE.

GritForge is a productivity and habit-tracking tool only. It is not a substitute for medical diagnosis or treatment, mental health counseling or therapy, professional coaching or consulting, or crisis intervention services. If you have a medical or mental health concern, consult a qualified professional.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRITFORGE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Services
• Damages arising from AI-generated content
• Damages arising from unauthorized access to your account

10.2 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED:

The greater of: the amount you paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless GritForge and its officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, your violation of these Terms, your violation of any third-party rights, or your violation of any applicable law.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at support@gritforge.io to attempt to resolve any dispute informally. We will make good-faith efforts to resolve disputes within 60 days.

12.2 Binding Arbitration

If we cannot resolve a dispute informally, you agree that any dispute will be resolved by binding arbitration rather than in court, except for claims in small claims court, enforcement of intellectual property rights, and claims for injunctive relief.

12.3 Class Action Waiver

YOU AND GRITFORGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

If you access the Services from outside the United States, you are responsible for compliance with local laws and consent to data transfer to the United States.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date. For material changes, we will provide notice via email or in-app notification at least 30 days before changes take effect.

Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GritForge regarding the Services.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: We are not liable for any failure or delay due to circumstances beyond our reasonable control.
